Regulators Investigate Barstool Sports’ Promotion in Massachusetts

The Barstool Sportsbook is expected to face legal action from the Massachusetts Gaming Commission for utilizing unfair or misleading marketing in a sports betting offer. Can’t Lose was utilized in the promotion offer made by Barstool celebrity Dan Katz.

Barstool Violates Massachusetts’s Sports Betting Law

Massachusetts lawmakers were informed by Penn CEO Jay Snowden that the branding was intended as not being serious, but rather amusing, and not meant to mislead people. Moreover, Snowden said that Penn had permanently ceased utilizing the “Can’t Lose” advertising. Dan Katz, according to Snowden, is one of the worst gamblers in the entire world.

State authorities, though, don’t seem to be amused. Massachusetts has among of the nation’s harshest advertising laws, similar to those in Ohio. Michigan and New Jersey, one of the first states to legalize online sports betting, are more lenient when it comes to advertising laws.

This is the second advertising infraction made by Barstool in the past two months. Barstool, one of the most popular gambling operators in Michigan and hopefully, in the future, one of the licensed platforms for real money gambling in New Jersey and other states, has recently been acquired by PENN Entertainment. PENN was fined $250,000 by Ohio officials in February for advertising its sportsbook close to the University of Toledo. Such marketing, including appearances by Barstool characters, is against Ohio gaming legislation.

Possible Ramifications for Barstool Sports

Chief Enforcement Counsel and Deputy Director of the Investigations and Enforcement Bureau (IEB) for the MGC, Loretta Lillios, was the one who initially reported the infraction.

Lillios claims that the Attorney General’s office in Massachusetts acted swiftly in response to the marketing campaign by Barstool. In her testimony before the IEB, the AG used consumer protection law to argue that sports betting businesses must adhere to all applicable rules and regulations.

Following the event, the MGC had a number of options for punishing Barstool. Any other operator infringing on MA gaming legislation would face the same penalties, including:

  • Suspend or revoke a license for sports betting.
  • License modification for the operator.
  • Levy a fine against the operator.

The IEB may also propose a solution for any breaches of state gaming law in addition to taking additional action.

Outsiders To Consider for the 2023 Cheltenham Festival

With 28 races at the 2023 Cheltenham Festival, there are lots of opportunities to find some outsiders who could outrun their odds at the meeting. Last year the biggest priced winner was Commander Of Fleet who prevailed on day two at 50/1.

Here are three horses who look overpriced to add their name to the Cheltenham Festival roll of honour in 2023.

Diverge – Supreme Novices’ Hurdle (14/1)

Irish trainer Willie Mullins has won the Supreme Novices’ Hurdle seven times. He has a great chance of extending his tally to eight this year. One of his contenders is Diverge, a novice hurdler who could not have been any more impressive when winning by 23 lengths in a large field handicap at Punchestown last month.

As you can see from the Cheltenham Festival betting guide, the Supreme Novices’ Hurdle is the opening race on Champion Day. Facile Vega, also trained by Mullins, is the favourite to prevail this year. However, such is the strength of Mullins’ yard, that it would not be a surprise if one of his other runners wins this race. Diverge is 14/1 to beat his stablemates and the rest of the leading 2m novice hurdlers this year. 

Funambule Sivola – Queen Mother Champion Chase (33/1)

Energumene and Funambule Sivola finished first and second respectively in the 2022 Queen Mother Champion Chase. The defending champion is 15/8 to defend his title, while last year’s runner-up is as big as 33/1 to go one place better. That’s a huge difference in price between those two horses, especially when you consider Mullins’ chaser was beaten in the Clarence House Chase at Cheltenham on his last outing.


Funambule Sivola was back to his best on his latest appearance at Newbury in the Grade Two Betfair Game Spirit Chase. Venetia Williams’ runner scored by just over three lengths. If he builds on that performance when he returns to the Festival, he should not be ignored in what looks like a thrilling renewal of the Championship race on day two.

Eldorado Allen – Cheltenham Gold Cup (66/1)

Talented chaser Eldorado Allen has finished second in two major races this season in the 3m chase division. He chased home Bravemansgame in the Charlie Hall Chase at Wetherby back in October, while a month later, he was runner-up behind Protektorat in the Betfair Chase at Haydock. Despite that form, he can be backed at 66/1 for the Cheltenham Gold Cup.


The Tizzard family won the Blue Riband event of the Cheltenham Festival in 2018 with Native River, so they know exactly how to prepare a horse for this race. If you take Galopin Des Champs out of the field for this year’s renewal, it is wide open. There are also some question marks about Mullins’ chaser’s stamina over this 3m2½f distance, so there are grounds to take him on. Eldorado Allen is good enough on his day to cause an upset in this race and win the biggest prize of his career.

From a 93-rated, below-average hurdler, to a 6/1 second favourite for victory at the Cheltenham Festival, it has been a long and winding road for Maxxum.

One of the most improved horses in training today, Maxxum has progressed through the hurdling ranks at a rate of knots and is now just a step away from adding a festival win to his name in the Pertemps Network Final.

An Owner’s Dream

A horse like Maxxum is a dream horse for any owner. Yes, having a racehorse that can race at a top level early in their career would be the obvious choice, but those horses are usually only available to the wealthiest of owners.

Maxxum’s career could not have started at a lower level. Just over 12 months ago, the then 5yo made his debut in a Maiden Hurdle at Fairyhouse, going off as a 125/1 also ran and eventually trailed in a full 50 lengths behind the winner.

His next two starts would see him go off at prices of 125/1 and 100/1, this time being beaten by 45 lengths and 32 lengths respectively. Connections must have been wondering if was it worth their while continuing with the son of Westerner, but they decided to have one more try and were ultimately rewarded for their faith when Maxxum won his first race at Clonmel racecourse in March last year.

Three decent efforts followed, but it was when switched to the powerful yard of Gordon Elliott that Maxxum’s career would take off at an exceptional rate.

Off a lowly handicap mark of 99, Maxxum finished second on his first start for his new trainer, but would then go on to win his next two races, the second of which was a valuable Handicap Hurdle at the Leopardstown Christmas Festival.

That victory moved Maxxum to a mark of 138, meaning he had now risen an amazing 45 lbs in under a year. 

Can Maxxum Win At Cheltenham?

The Pertemps Handicap Hurdle is a notoriously hard race to win at the Cheltenham Festival, but Maxxum may not be finished improving just yet and deserves to take his chance in the wide-open race.

His chances of victory took a knock with him finishing well down the field back at Leopardstown last time, but there were excuses for that run and if he can bounce back to his best, come festival time, Maxxum’s rise to the top could well reach its pinnacle at Cheltenham 2023.

The Kentucky Derby is one of the most popular horse races in the United States, if not the world. Held annually in Louisville, Kentucky, the competition is a Grade I stakes race that sees three-year-old thoroughbreds run a distance of one and a quarter miles.

Aside from being an incredibly entertaining event, the Kentucky Derby is also rich in history and tradition. For starters, it’s the longest-running sporting event in the US, with the first race taking place in 1875.

Other traditions include statement hats and mint juleps, however, the best tradition has to be the naming of the horses. The Kentucky Derby is known for the greatest horse names ever. So much so, in preparation for Kentucky Derby 2023, we’re going to look at the very best.

In this post, you’ll find a list of the 5 greatest Kentucky horse names of all time. Let’s take a look!

1. Spectacular Bird

The first horse name we have for you is Spectacular Bird. Spectacular Bird didn’t just have an awesome name, he was also an impressive stallion that won 26 out of the 30 races it raced in.

Winning almost $3 million dollars, which was a record at the time, Spectacular Bird was a champion throughout the 1978 season. The stallion won the Kentucky Derby in 1979. Ronnie Franklin, Spectacular Bird’s jockey, won the Kentucky Derby on his debut.

Other well-known races this horse won include the Champagne Stakes, the Marlboro Cup, and the Preakness Stakes. In 1980, Spectacular Bird won 9 races in a row, which saw the horse win American Horse of The Year for that year.

2. Genuine Risk

Genuine Risk is one of only three fillies to ever win the Kentucky Derby. The other two were Winning Colors in 1988 and Regret in 1915, both of which also have epic names. Genuine Risk won the Kentucky Derby in 1980 becoming the second filly to win the famed event.

Ridden by Jacinto Vasquez, Genuine Risk went on to do well in other races too, finishing second in the Belmont Stakes and the Preakness Stakes. An interesting story that surrounds this horse is how it finished second in a very controversial Preakness Stakes race.

Genuine Risk was bumped, carried, and hit in the face by eventual winner Codex. Despite debates to see Genuine Risk awarded the crown, Codex was still declared the winner. Genuine Risk won more than $600,000 in her career.

3. Smarty Jones

The next horse on our list is Smarty Jones. Smarty Jones is another Kentucky Derby horse that had a fantastic name and a successful career. Ridden by jockey Stewart Elliot, Smarty Jones won the Kentucky Derby in 2004, along with the Preakness Stakes.

Smarty Jones ended a decades-long wait when he became the first undefeated horse to win the Kentucky Derby since Seattle Slew in 1977. Interestingly, Elliot also became the first jockey to win the Kentucky Derby on a debut race since Ronnie Franklin on Spectacular Bird in 1979.

This stallion was named after Milly “Smarty Jones” McNair, the co-owners mother. When it came to career winnings, Smarty Jones won a whopping $7.6 million.

4. Die Hard

Despite seemingly taking inspiration from the movies, Die Hard didn’t get its name from the Bruce Willis action film. We know this because Die Hard raced in 1959, 30 years before the first Die Hard film came out.

That doesn’t stop this horse from having a cool name though. Born in 1956, sired by Never Say Die, and trained by Joe Bollero, Die Hard didn’t have much success as a racehorse, but he certainly had one of the greatest names.

Die Hard only ever raced in the Kentucky Derby once. That was in 1959 when Die Hard sadly finished 16th. The winner that year was Tomy Lee.

5. American Pharoah

The final Kentucky Derby horse on our list is American Pharoah. As far as the greatest names go, this one takes some beating. American Pharoah was an extremely successful racehorse, so it’s probably fair to say the name suits.

Winning more than $8 million in his career, this stallion has won a wide range of famous races. This includes the 2015 Kentucky Derby, Preakness Stakes, and Belmont Stakes. In fact, American Pharoah is one of a select few horses that’s won the Triple Crown.

American Pharoah also won the Breeder’s Cup, Rebel Stakes, and Haskell Invitational amongst a few others. It won’t come as a surprise to learn that this horse also won American Horse of the Year.

Final Thoughts

February is an interesting month from a betting point of view. In horse racing terms, it can be tricky with bad weather interrupting the schedule and many horses being prepared for Cheltenham as more of a warm-up than anything else.
